LEGISLATION ACT 2001 - SECT 70

Making of amendment restoring effect of law within 6 months after amendment

    (1)     This section applies if a subordinate law or disallowable instrument (the amended law ) is amended under section 68 (Amendment by resolution of Assembly).

    (2)     A subordinate law or disallowable instrument the same in substance as the amended law before the amendment (the earlier law ) must not be made within 6 months beginning on the day the amendment is made unless the Legislative Assembly has—

        (a)     rescinded the resolution that made the amendment; or

        (b)     by resolution approved the making of—

              (i)     a subordinate law or disallowable instrument in those terms; or

              (ii)     a subordinate law or disallowable instrument the same in substance as the earlier law.

    (3)     A subordinate law or disallowable instrument made in contravention of this section is void.

    (4)     This section is a determinative provision.
