LEGISLATION ACT 2001 - SECT 66

Revival of affected laws

    (1)     This section applies if—

        (a)     a subordinate law or disallowable instrument (the disallowed law ) is taken to be repealed under section 64 (Presentation of subordinate laws and disallowable instruments) or section 65 (Disallowance by resolution of Assembly); and

        (b)     the disallowed law repealed or amended an Act or statutory instrument (the affected law ); and

        (c)     the repeal or amendment has commenced.

    (2)     The affected law is revived, from the beginning of the day after the disallowed law is taken to have been repealed, as if the disallowed law had never been made.

    (3)     This section is a determinative provision.
