LEGISLATION ACT 2001 - SECT 228

Consultation with relevant Assembly committee

    (1)     Before making an appointment to a statutory position, a Minister must consult the relevant Assembly committee.

    (2)     The committee may make a recommendation to the Minister about the proposed appointment.

    (3)     The Minister must not make the appointment until the Minister has received a recommendation or 30 days have passed since the consultation took place, whichever happens first.

    (4)     In making the appointment, the Minister must have regard to any recommendation received.

    (5)     In this section:

"relevant Assembly committee" means a standing committee of the Legislative Assembly nominated, in writing, by the Speaker for subsection (1).
