LEGISLATION ACT 2001 - SECT 170
Privileges against self-incrimination and exposure to civil penalty(1) An Act or statutory instrument must be interpreted to preserve the common law privileges against self-incrimination and exposure to the imposition of a civil penalty.
(2) However, this section does not affect the operation of the Evidence Act 2011
.
Note The Evidence Act 2011
, s 128 contains provisions that apply if a witness raises these privileges in a proceeding. The privileges have been abolished for bodies corporate (see Evidence Act 2011
, s 187).
(3) This section is a determinative provision.
