LEGISLATION ACT 2001 - SECT 126

    (1)     A heading to a chapter, part, division, subdivision, schedule, or another provision (other than a section or subsection), of or to an Act or statutory instrument is part of the Act or instrument.

    (2)     A heading to a section or subsection of an Act or statutory instrument is part of the Act or instrument if—

        (a)     the Act was enacted, or the instrument was made, after 1 January 2000; or

        (b)     the heading was amended or inserted into the Act or instrument after 1 January 2000.

    (3)     A preamble or other recital to an Act or statutory instrument is part of the Act or instrument.

    (4)     An example or diagram in an Act or statutory instrument is part of the Act or instrument.

    (5)     A schedule, dictionary or appendix to an Act or statutory instrument is part of the Act or instrument.

    (6)     Punctuation in an Act or statutory instrument is part of the Act or instrument.

    (7)     A provision number in an Act or statutory instrument is part of the Act or instrument.

    (8)     In applying this section to an Act or statutory instrument that is divided otherwise than into sections, a reference to a section or subsection is a reference to a corresponding provision of the Act or instrument.

Note     A reference to an Act or statutory instrument includes a reference to a provision of the Act or instrument (see s 7 and s 13).

    (9)     This section is a determinative provision.
