LAKES ACT 1976 - SECT 22

Closing of parts of lake for certain events

    (1)     The Minister may, by notice published in a daily newspaper, declare a part of a lake to be a closed area for the period stated in the notice.

    (2)     The Minister may also, by the notice, authorise an entity to conduct a stated event in the closed area during the stated period.

Note     Entity includes an unincorporated body, see Legislation Act, dict, pt 1.

    (3)     A person commits an offence if—

        (a)     the person enters the closed area during the period stated in the notice; and

        (b)     if subsection (2) applies—the entry is not authorised by the entity authorised by the notice.

Maximum penalty: 50 penalty units.

    (4)     An offence against this section is a strict liability offence.

    (5)     In this section:

"event" means a regatta, exhibition, sporting contest or other display.
