Australian Capital Territory Consolidated Acts(1) If it appears to the commissioner that a person has carried on business in contravention of an approved code, the commissioner may request the person to execute within a stated time a deed in terms approved by the commissioner under which the person gives undertakings about all or any of the following:
(a) discontinuance of the conduct;
(b) future compliance with the code;
(c) the action the person will take to rectify any consequence of the contravention.
(2) In considering whether to require a person to give an undertaking under subsection (1), the commissioner must have regard to any dispute resolution process stated in the approved code.
(3) This section does not limit section 51A (Enforcement of undertakings).
