FOOD ACT 2001 - SECT 27
Compliance with food standards code(1) A person commits an offence if the person contravenes a requirement of the food standards code in relation to—
(a) the conduct of a food business; or
(b) food intended for sale; or
(c) food for sale.
Maximum penalty: 500 penalty units.
(2) A person commits an offence if—
(a) the person sells food; and
(b) the food does not comply with a requirement of the food standards code for the food.
Maximum penalty: 500 penalty units.
(3) A person commits an offence if—
(a) the person sells or advertises food; and
(b) the food is packaged or labelled in a way that contravenes the food standards code.
Maximum penalty: 500 penalty units.
(4) A person commits an offence if the person sells food, or advertises food for sale, in a way that contravenes the food standards code.
Maximum penalty: 500 penalty units.
(5) An offence against this section is a strict liability offence.
