ENVIRONMENT PROTECTION ACT 1997 - SECT 9
Civil remedies and common law not affected(1) Except as expressly provided by this Act, nothing in this Act must be taken to affect any civil right or remedy available to a person in relation to conduct to which this Act applies.
(2) Compliance with this Act is not, of itself, evidence that a common law duty of care has been satisfied.
