ELECTORAL ACT 1992 - SECT 290

Employees' right to leave of absence for voting

    (1)     On notification from an employee before a polling day, the employer shall allow the employee, without penalty or any disproportionate deduction of pay, to take any necessary leave (not exceeding 2 hours) for the purpose of voting.

Maximum penalty: 10 penalty units.

    (2)     Subsection (1) does not apply if the absence of the employee from employment could—

        (a)     endanger any person, animal or thing; or

        (b)     cause substantial loss to any person.

    (3)     An employee shall not notify an employer under subsection (1) if the employee does not have a genuine intention of voting during the period of the leave to be granted for the purpose of voting.

Maximum penalty: 5 penalty units.
