ELECTORAL ACT 1992 - SECT 189

Declaration of result of election

    (1)     As soon as practicable after the result of the poll in an election has been ascertained, the commissioner shall—

        (a)     declare elected each successful candidate ascertained in accordance with schedule 4;

        (b)     declare the result of the election; and

        (c)     notify the clerk of the Assembly of the names of the candidates elected.

    (2)     The declaration shall be made in public at the place of nomination during ordinary office hours.

    (3)     If a day is polling day for 2 or more elections, the results of all the elections shall be declared, so far as practicable, on the same day.

    (4)     If a poll is not required for an election, a declaration under section 111 (1) or 112 shall not be made before the day that would have been polling day for the election.
