ELECTORAL ACT 1992 - SECT 164

Final notice

    (1)     The commissioner shall send a final default notice to an elector if—

        (a)     a default notice under section 162 or 163 has been sent to the elector; and

        (b)     the time for responding to the notice has ended; and

        (c)     the elector has not paid the prescribed penalty; and

        (d)     the commissioner is not satisfied that the elector—

              (i)     voted at the election; or

              (ii)     had a valid and sufficient reason for failing to vote at the election.

    (2)     A final default notice shall contain a statement to the effect that—

        (a)     the commissioner is not so satisfied; and

        (b)     if the elector does not wish to have the matter dealt with by a court—the elector may, within the time specified in the notice, pay the amount of the prescribed penalty.
