DRUGS OF DEPENDENCE ACT 1989 - SECT 164

Sale or supply

    (1)     In this section:

"prohibited substance" does not include cannabis.

    (2)     A person shall not—

        (a)     sell or supply a drug of dependence to any person; or

        (b)     participate in the sale or supply of a drug of dependence to any person; or

        (c)     possess a drug of dependence for the purpose of sale or supply to any person.

Maximum penalty: 500 penalty units, imprisonment for 5 years or both.

    (3)     A person shall not—

        (a)     sell or supply a prohibited substance to any person; or

        (b)     participate in the sale or supply of a prohibited substance to any person; or

        (c)     possess a prohibited substance for the purpose of sale or supply to any person.

Maximum penalty: 500 penalty units, imprisonment for 5 years or both.

    (4)     Subsection (2) does not apply if the person is authorised under the Medicines, Poisons and Therapeutic Goods Act 2008

, or another territory law, to sell or supply the drug of dependence.

    (5)     Subsection (3) does not apply if the person is authorised under the Medicines, Poisons and Therapeutic Goods Act 2008

, or another territory law, to sell or supply the prohibited substance.
