Australian Capital Territory Consolidated Acts(1) Section 20 or section 22 does not make it unlawful for a club to discriminate against a person on the ground of age if the club's principal object is providing benefits for people belonging to a particular age group.
(2) In deciding what the principal object of a club is for subsection (1), the following must be taken into account:
(a) the essential character of the club;
(b) if the people mainly enjoying the benefits of membership belong to the particular age group stated in the club's objects;
(c) any other relevant circumstances.
