DISCRIMINATION ACT 1991 - SECT 50
Discrimination by qualifying bodies etc(1) Section 16 does not make unlawful discrimination by an authority or body against a person on the ground of disability if the authority or body believes on reasonable grounds that, because of a disability, the person is, or would be, unable to carry out work that is essential to the position concerned.
(2) In this section:
"disability" does not include anything mentioned in—
(a) section 5AA (2) (b) or (c) (Meaning of disability etc); or
(b) section 7 (2) (Protected attributes), other than a disability that the person has.
