CORRECTIONS MANAGEMENT ACT 2007 - SECT 143

Visiting conditions

    (1)     The director-general may declare conditions that apply in relation to visits to a correctional centre.

Examples of conditions declared

1     the times and duration of visits

2     the number of visitors allowed

3     the conditions for conjugal, contact and non-contact visits

4     the circumstances in which visitors may be monitored

5     a prohibition on smoking in nonsmoking areas

    (2)     A declaration is a disallowable instrument.

Note 1     The power to make an instrument includes power to make different provisions in relation to different matters or different classes of matters, and provisions that apply differently by reference to stated exceptions or factors (see Legislation Act

, s 48).

Note 2     A disallowable instrument must be notified, and presented to the Legislative Assembly, under the Legislation Act
