    (1)     This part applies to civil liability of any kind.

    (2)     However, this part does not apply to civil liability for an award of damages or compensation—

        (a)     for defamation; or

        (b)     under any of the following:

              (i)     the Discrimination Act 1991

              (ii)     the Workers Compensation Act 1951
