Australian Capital Territory Consolidated Acts(1) A person commits an offence if—
(a) the person possesses—
(i) a film classified RC; or
(ii) an unclassified film; and
(b) the person intends to sell or exhibit the film.
Maximum penalty: 100 penalty units, imprisonment for 1 year or both.
(2) Subsection (1) does not apply if the person possesses the film for classification or law enforcement.
(3) A person commits an offence if—
(a) the person copies a film; and
(b) the film is—
(i) classified RC; or
(ii) an unclassified film; and
(c) the person intends to sell or exhibit the film.
Maximum penalty: 100 penalty units, imprisonment for 1 year or both.
(4) Subsection (3) does not apply if the person copies the film for classification or law enforcement.
(5) If, in a prosecution for an offence against
subsection (3), it is proved that the defendant made 10 or more copies of a
film classified RC, or an unclassified film, it is presumed, unless the
contrary is proved, that the defendant intended to sell or exhibit the film.
