CLASSIFICATION (PUBLICATIONS, FILMS AND COMPUTER GAMES) (ENFORCEMENT) ACT 1995 - SECT 20

    (1)     A person commits an offence if—

        (a)     the person possesses an unclassified film or a film classified RC at any premises; and

        (b)     classified films are sold at the premises.

Maximum penalty: 100 penalty units, imprisonment for 1 year or both.

    (2)     A person commits an offence if—

        (a)     the person is the occupier of premises; and

        (b)     someone else possesses an unclassified film or a film classified RC at the premises; and

        (c)     classified films are sold at the premises.

Maximum penalty: 100 penalty units, imprisonment for 1 year or both.

    (3)     In this section:

"possess" a film includes—

        (a)     have control over the disposition of the film (whether or not having custody of the film); and

        (b)     have joint possession of the film.
