CHILDREN AND YOUNG PEOPLE ACT 2008 - SECT 814

Power to enter premises—ch 13 (Care and protection—emergency situations)

    (1)     For this Act, an authorised person or police officer may, at any time, enter premises if—

        (a)     the authorised person or police officer believes on reasonable grounds that a child or young person at the premises is in need of emergency care and protection; and

Note     In need of emergency care and protection is defined in s 403.

        (b)     the purpose of the entry is for the authorised person or police officer to take emergency action for the child or young person under section 406.

Note     Emergency action is defined in s 405.

    (2)     The authorised person or police officer may use reasonable and necessary force to enter the premises to safeguard the wellbeing of the child or young person.

    (3)     This section is additional to section 813.
