CHILDREN AND YOUNG PEOPLE ACT 2008 - SECT 148

Prohibited things

    (1)     The director-general may declare a thing to be a prohibited thing if the director-general believes on reasonable grounds that the declaration is necessary or prudent to ensure security or good order at a detention place.

Examples—prohibited things

1     a weapon or something crafted as a weapon

2     alcohol

3     a controlled drug under the Criminal Code

4     a mobile phone

Note     The power to make an instrument includes power to make different provisions in relation to different matters or different classes of matters, and provisions that apply differently by reference to stated exceptions or factors (see Legislation Act

, s 48.)

    (2)     A declaration is a notifiable instrument.

Note     A notifiable instrument must be notified under the Legislation Act
