CHILDREN AND YOUNG PEOPLE ACT 2008 - SECT 115
General agreements with other jurisdictions(1) The Minister may enter into an agreement (a transfer agreement ) with a Minister of a State, or a person authorised to enter into a transfer arrangement for the Minister, providing generally for the transfer of young offenders—
(a) from or to the ACT; or
(b) through the ACT from a State to another State.
(2) A transfer agreement relating to a State must not be entered into unless a declaration under subsection (3) has been notified under the Legislation Act
in relation to the State.
(3) The Minister may declare that a State has enacted legislation dealing with the interstate transfer of young offenders.
(4) A declaration is a notifiable instrument.
