BUILDING ACT 2004 - SECT 97

    (1)     This section applies if the trustees of a fidelity fund scheme apply to the territory planning authority for approval of the scheme.

    (2)     The territory planning authority may, by written notice given to the trustees, require the trustees to give the authority—

        (a)     stated additional information or documents that the authority reasonably needs to decide the application; or

        (b)     a statement about a stated matter in relation to information or documents provided in relation to the application.

Note     It is an offence to make a false or misleading statement, give false or misleading information or produce a false or misleading document (see Criminal Code

, pt 3.4).

    (3)     The territory planning authority need not consider the application further until the trustees comply with the requirement.
