BAIL ACT 1992 - SECT 9A

    (1)     This section applies to—

        (a)     a person in relation to an offence other than an offence mentioned in section 8 (1) (a) or (b) (Entitlement to bail—certain minor offences etc); and

        (b)     a person who is not entitled to bail under section 8 (2) because of section 9 (1) or (2).

    (2)     The person is entitled to be granted bail unless the court or authorised officer is satisfied that refusal is justified after considering—

        (a)     for an adult—the matters mentioned in section 22 (Criteria for granting bail to adults); or

        (b)     for a child—the matters mentioned in section 23 (Criteria for granting bail to children).
