BAIL ACT 1992 - SECT 51

Indemnification of sureties

    (1)     A person commits an offence if the person indemnifies, or agrees to indemnify, anyone else against a liability the other person incurs or may incur as surety for an accused person.

Maximum penalty: 200 penalty units, imprisonment for 2 years or both.

    (2)     A person commits an offence if the person is indemnified, or agrees to be indemnified, by someone else against a liability the person incurs or may incur as surety for an accused person.

Maximum penalty: 200 penalty units, imprisonment for 2 years or both.

    (3)     For this section, it does not matter whether—

        (a)     the agreement is for compensation in money or anything else; or

        (b)     the agreement is made before or after the person indemnified, or agreed to be indemnified, becomes a surety; or

        (c)     the person indemnified, or agreed to be indemnified, becomes a surety.
