Australian Capital Territory Consolidated Acts(1) If an accused person in police custody is to be brought, for the first time in relation to the offence, before a court more than 4 hours after the person came into custody—
(a) the police officer for the time being in charge of the police station where the person is in custody; or
(b) if the person is not in custody at a police station—the police officer who has custody of the person;
shall, if it is reasonably practicable to do so, cause the person to be provided with, and allowed to use—
(c) facilities to enable the accused person to wash, shower or bathe and (if appropriate) to shave; and
(d) facilities to enable the accused person to change his or her clothing.
(2) Nothing in subsection (1) requires a police officer, the Territory or the Commonwealth to provide clothing for the accused person unless the clothing is brought to the police station or other place where the accused person is in custody by a member of the accused person's family or some other person.
