Australian Capital Territory Consolidated Acts Australian Capital Territory Consolidated Acts(1) Subject to subsection (2), an authorised officer may grant bail in accordance with this Act to an accused person who is present at a police station.
(2) An authorised officer must not grant bail to a person accused of an offence if—
(a) a decision about bail in relation to the offence has been made by a court; or
(b) the offence is a domestic violence offence of murder.
Note A reference to an offence against a territory law includes a reference to a related ancillary offence, eg attempt (see Legislation Act, s 189).
