Australian Capital Territory Consolidated Acts Australian Capital Territory Consolidated Acts(1) This section applies to a licensed agent who is a licensed real estate agent, licensed stock and station agent or licensed business agent.
(2) A licensed agent commits an offence if—
(a) the agent employs a person to provide a service, in relation to the agent's business, that a person must be licensed or registered to provide; and
(b) the person provides the service; and
(c) either––
(i) the person is not licensed or registered to provide the service; or
(ii) the person is licensed or registered to provide the service but the licence or registration is suspended.
Maximum penalty: 50 penalty units.
(3) An offence against subsection (2) is a strict liability offence.
