Australian Capital Territory Consolidated Acts(1) A licensed agent commits an offence if the licensed agent is responsible for the day-to-day management of 2 or more places of business.
Maximum penalty: 100 penalty units.
(2) A licensed agent commits an offence if—
(a) the licensed agent—
(i) is employed to be responsible for the day-to-day management of another licensed agent's place of business; and
(ii) provides services for 2 or more licensed agents at the place; and
(b) the licensed agents to whom the services are provided are not in partnership with each other.
Maximum penalty: 100 penalty units.
(3) An offence against this section is a strict liability offence.
(4) This section does not apply to—
(a) a licensed travel agent; or
(b) a licensed employment agent.
(5) A person may be exempted from this section under section 71.
