EXPLANATORY MEMORANDUM



Outline


This Bill sets out a series of amendments to the Public Access to Government Contracts Act 2000 to make available the text of tender documents that have been successful in winning government contracts.

Revenue/Cost Implications


There will be minor compliance costs as this bill extends the scope of the current Public Access to Government Contracts Act.

Formal Clauses


Part 1- Preliminary


Clauses 1 and 2 are formal requirements. They deal with the short title of the Bill, and the commencement provisions.

Clause 3 identifies the Act being amended.

Clause 4 amends the definition of ‘government agency’ to include the University of Canberra and University of Canberra College Pty Ltd in the definition for the purpose of this Act.


Clause 5 amends the definition of ‘public text’ to include the text of tenders.

Clause 6 adds a new section on the ‘public text of tender’. This will mean that as far as possible, the text of winning tenders will be made public.

Clause 7 amends the current section 7 to include that winning tenders are also made public. The contracts and tenders are to be made available in hard copy for a fee, or electronically (on the internet or via email) without charge.
