EXPLANATORY STATEMENT
PURPOSE
The purpose of this Bill is to ensure
that pharmacists in the ACT operate out of their own premises and not as
sub-lessees of supermarkets.
This amendment Bill, in essence, tightens up the
pharmacy legislation that stipulates that pharmacies must be owned and operated
by registered pharmacists (s9A, s48 and s48A of the Pharmacy Act). If a
pharmacist operates as a sub-lessee, it brings into doubt who is operating the
pharmacy-the pharmacist or the lessee. This amendment will remove any such doubt
through prohibiting pharmacists to operate a pharmacy as a
sub-lessee.
This bill will ensure pharmacists
continue to operate with the health needs of the community as a major
priority.
This Bill will not affect any pharmacist
currently operating in the ACT, including those operating in shopping centres
and town centres.
FINANCIAL
IMPLICATIONS
This Bill will have no revenue
impact on the ACT.
