LEGAL PRACTITIONERS AMENDMENT BILL 2002
Outline
This is a bill to amend the Legal Practitioners Act
and will prohibit the advertising of services by legal practitioners as
“no win, no fee”. That is, under this act it will be illegal for a
solicitor to suggest in his advertising that the solicitor will not charge costs
as between a solicitor and a client if the client’s litigation is
unsuccessful.
Clause Notes
Clauses 1 - 2
These clauses cover formal requirements which
set out the name of the Act and its commencement provisions.
Clause 3
This clause names the Act amended (the Legal Practitioners Act
1970)
Clause 4
This clause inserts a new section 196A into the Act which will outlaw
the advertising of “no win, no fee” services.
