STATEMENT
Outline
The amendment to the dictionary meaning of
health service provider in the Health Act 1993 is required as the
original amendment inadvertently included a much broader category of health
service provider than intended under the current legislation. This was an
unintended consequence and is corrected by the following amendments.
Revenue/Cost
Implications
There is no additional cost involved in these
amendments to the Bill as all infrastructure is in place under the existing
regime.

Amendment 1
Schedule 1, part 1.3 Proposed new division 8.1
omits the new division 8.1 because the inclusion of a person registered
under the Health Professionals Act 2004 would extend the definition
beyond the current categories allowed under the Health Act 1993.
Amendment 2
Schedule 1, part 1.3 Proposed new division 8.2
heading omits the heading to division 8.2 as the heading is no longer
necessary given the proposed amendment. Only the heading is removed, the rest
of the provision concerning definitions in the Health (Fees) Determination
2003-04 DI2003-150 remains.
Amendment 3
Schedule 1, part 1.3 Proposed new division 8.3
heading omits the heading to division 8.3 as the heading is no longer
necessary given the following proposed amendment.
Amendment 4
Schedule 1, part 1.3 Dictionary, definition of health
service provider substitutes a new definition of health service provider to
ensure that the categories listed are the same as the categories under the
existing health professionals legislation.
