AMENDMENT BILL 2004 (No 2)


Outline


The Gaming Machine Amendment Bill 2004 (No 2) will amend the Gaming Machine Act 1987 (The Act). The Bill enables hotels and taverns access to class B gaming machines. The Bill further enables clubs that have more than one premises to transfer machines within the total number of machines held within the club between premises.

Clause Notes


Clause 1 – Name of Act – Provides that upon enactment, the Bill will be titled the Gaming Machine) Amendment Act (No 2)

Clause 2 – Commencement – provides that the provisions of the Bill will commence on the day after notification day.

Clause 3 – Act Amended – provides that the Bill will amend the Gaming Machine Act 1987

Clause 4 – Conditions for issue of license - Gaming Machines section 18(2) and (3)

Substitutes a new 18(2), (3) and (4). Subsection 2 enables hotels (who have a general licence) and taverns (who have an on licence) to have access to Class B gaming machines.
Subsection 3 enables general licence premises (i.e. hotels) that have 12 rooms or more for residential accommodation for lodgers access to up to 10 Class B gaming machines and enables premises that do not have accommodation or have less than 12 rooms for that purpose to have access to up to 2 Class B gaming machines.
Subsection 4 enables on licence premises (i.e. taverns) to have up to 2 Class B gaming machines.
Subsection 5 ensures that a license for gaming machines cannot be issued for a premise to which an on license applies unless the license is stated to be for the primary purpose of running a tavern/bar.

Clause 5 – New section 21A enables a licensed club that has a licence or licences in more than one premises to move gaming machines between the licence premises run by the club within the total number of machines for which all the clubs licence premises are licensed to operate.
