EXPLANATORY STATEMENT

BACKGROUND

The Asbestos Legislation Amendment Bill 2006 (No 2) (the Bill) amends the Asbestos Legislation Amendment Act 2006 (the Act) to provide for a minor technical amendment to the commencement provisions of the Act.

The provisions of the Act, as proposed, always intended that the legislation should commence from 1 July 2006, and this was reflected in various announcements by Government.

The Act currently provides for a commencement 7 days after its notification. This, together with the early passage of the legislation through the Legislative Assembly, meant that the timing of the commencement of the Act may have not given some stakeholders sufficient time to put in place all necessary arrangements to support the introduction of the new residential asbestos management regime.

This Bill will amend section 2 (1) of the Act to provide for a commencement date of
1 July 2006, to more accurately reflect the intention of this Government and to provide greater certainty to those professions and industries affected.

FINANCIAL IMPLICATIONS


The matters proposed by this Bill do not have any financial implications.

NOTES ON SPECIFIC PROVISIONS

Clause 1 Name of Act

This clause provides that the name of this Act is the Asbestos Legislation Amendment Act 2006 (No 2).

Clause 2 Commencement

This clause provides that this Act commences on the day after its notification date.

Clause 3 Legislation amended

This clause provides that this Act amends the Asbestos Legislation Amendment Act 2006.

Clause 4 Section 2 (1)

This clause omits ‘the 7th day after its notification’ and substitutes ‘1 July 2006’ to provide that the Act being amended commences on a particular day.
