Amendment Bill 2003
A Bill for
An Act to amend the
Drugs of Dependence Act
1989
The Legislative Assembly for the Australian Capital Territory enacts as
follows:
This Act is the Drugs of Dependence Amendment Act 2003.
This Act commences on the day after its notification day.
Note The naming and commencement provisions automatically commence
on the notification day (see Legislation Act, s 75 (1)).
This Act amends the Drugs of Dependence Act 1989.
4 Cultivation
of prohibited plantsSection 162 (2),
penalty, paragraph (a)
substitute
(a) if not more than 5 cannabis plants are cultivated—1 penalty unit
for each cannabis plant cultivated; or
5 Prohibited
substances—possession, administration and
disposalSection 171 (1), penalty,
paragraph (a)

(a) if not more than 25g of cannabis is possessed—2 penalty units;
or

(8) The prescribed penalty for a simple cannabis offence
is—
(a) for an offence against section 162 (2) of cultivating, or
participating in the cultivation of, not more than 5 cannabis plants—$100
for each cannabis plant cultivated; and
(b) for any other simple cannabis offence—$200.
