A Bill for

An Act to amend the Drugs of Dependence Act 1989











The Legislative Assembly for the Australian Capital Territory enacts as follows:



1 Name of Act

This Act is the Drugs of Dependence Amendment Act 2003.

2 Commencement

This Act commences on the day after its notification day.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3 Act amended

This Act amends the Drugs of Dependence Act 1989.

4 Cultivation of prohibited plants

Section 162 (2), penalty, paragraph (a)

substitute

(a) if not more than 5 cannabis plants are cultivated—1 penalty unit for each cannabis plant cultivated; or

5 Prohibited substances—possession, administration and disposal

Section 171 (1), penalty, paragraph (a)

substitute

(a) if not more than 25g of cannabis is possessed—2 penalty units; or

6 Offence notices

Section 171A (3) (c)

(8) The prescribed penalty for a simple cannabis offence is—

(a) for an offence against section 162 (2) of cultivating, or participating in the cultivation of, not more than 5 cannabis plants—$100 for each cannabis plant cultivated; and

(b) for any other simple cannabis offence—$200.
