An Act to amend the Children and Young People Act 2008




The Legislative Assembly for the Australian Capital Territory enacts as
follows:

 1   1             Name of Act
 2                 This Act is the Children and Young People Amendment Act 2010.

 3   2             Commencement
 4                 This Act commences on the day after its notification day.
 5                 Note        The naming and commencement provisions automatically commence on
 6                             the notification day (see Legislation Act, s 75 (1)).

 7   3             Legislation amended
 8                 This Act amends the Children and Young People Act 2008.

 9   4             Daily care responsibility for children and young people
10                 Section 19 (2) (c)
11                 substitute
12                 (c) on the advice of a dentist or dental therapist--consent to dental
13                     treatment, including minor dental surgery, for the child or
14                     young person.

15   5             New section 19 (6)
16                 insert
17            (6) In this section:
18                 dental therapist--
19                 (a) means a person registered under the Health Practitioner
20                     Regulation National Law (ACT) Act 2010 to practise the health
21                     profession of dental therapist (other than as a student); and
22                 (b) for an activity, includes a person mentioned in paragraph (a)
23                     holding limited or provisional registration, to the extent that the
24                     person is allowed to do the activity under the person's
25                     registration.

 1   6    Offence--mandatory reporting of abuse
 2        Section 356 (2) (g)
 3        substitute
 4         (g) a person authorised to inspect education programs, materials or
 5             other records used for home education of a child or young
 6             person under the Education Act 2004;

 7   7    Annual review report--prepared at least annually
 8        Section 495 (a)
 9        substitute
10         (a) if the order is in force for 1 year or more--by, but not earlier
11             than 1 month before, the anniversary of the day the order was
12             made, in each year the order is in force;

13   8    Court may order sensitive information to be given or
14        produced
15        Section 866 (2)

17        a document given to it under subsection (1) (b)
18        insert
19        information given or produced to it under subsection (1)
