'Cash card' Bill for ACT

Bill to amend the Fair Trading (Amending) Bill 1996

The ACT shadow Attorney-General and consumer affairs spokesperson, Terry Connolly MLA (Labor) has released a draft private member's Bill to be introduced into the Australian Capital Territory Legislative Assembly. The key provision of the draft Bill is:

28A. A cash card provider shall not disclose to any person particulars of the use of a cash card where those particulars identify or tend to identify the user.

This will not apply where 'the user consents to the disclosure' or disclosure is required by a Court order or otherwise required by law. 'Cash card' is defined to mean a stored value card. A 'provider' is a person who carries on a business of providing cash cards.

Connolly's proposal is in response to the Belconnen ACT, trial of Mastercard's stored value card (see the article by Chris Connolly - no relation - in this issue). He states that the ALP believes it will receive Green and independent support for the Bill.
