THE ORDER OF THE SPECIALIST ADJUDICATOR IS THAT BY CONSENT OF BOTH PARTIES:

1. The Respondent withdraws the Remedial Action Notice served on 3 March 2004;
2. The Applicant withdraws Applications Numbered 5 and 6 referred to in ANNEXURE "A", of the Applicant’s Amended Dispute Resolution Application dated 23 March 2004;
3. The fees of the Specialist Adjudicator be paid by the parties in the following proportions:

(a) By the Body Corporate - $500.00; and

(b) By the Applicant - $1,600.00 plus GST (the GST amount assessed on the

total fee of $2,100.00).

4. Otherwise the Application be dismissed.
