DECISION

1 This is an application by the Australasian Meat Industry Employees' Union, Newcastle and Northern Branch (AMIEU) seeking the making of a new award in relation to employees of Bartter Enterprises and Steggles Foods Products Pty Limited ("the company") engaged at the company's Beresfield site.

2 The application was subject to hearing on 22 November 2005. Ms K Evans appeared for the AMIEU with Mr T McLean. Ms A Webster appeared on behalf of the company.

3 The award sought is the product of earnest negotiations between the parties. It is comprehensive and detailed in its prescription of wages and conditions of employment. The award supersedes all other industrial instruments and is the sole source of all employment conditions for all employees engaged at the site.

4 Ms Webster appearing submitted that the award sought provided certainty and flexibility for on site operations.

5 I am satisfied that the application meets all legislative requirements; that it conforms with the relevant State Wage Case principles; and that it is presented to the Commission with the genuine consent of the parties.

6 The Bartter Enterprises Steggles Foods Products Pty Limited Beresfield Site Operations AMIEU Integrated Award 2005-2008 is made in accordance with exhibit 1 with effect from the first pay period to commence on or after 22 November 2005 to remain in force until 30 June 2008.

7 The award will rescind and replace the Bartter Enterprises Steggles Foods Products Pty Limited Beresfield Site Operations AMIEU Integrated Award 2002-2005 (338 IG 972). An order of rescission issues herewith.
