Application by J. Blackwood & Son Limited Newcastle for approval of enterprise agreement

DECISION

[2003] NSWIRComm 33

1    This is an application by J. Blackwood & Son Limited Newcastle (‘the Company’) seeking approval of an enterprise agreement between the Company and the National Union of Workers, New South Wales Branch (‘NUW’).

2    The application was subject to hearing on 7 February 2003.

3    Ms V Weber of Employers First appeared on behalf of the Company. Correspondence was received by facsimile from the NUW on 4 February 2003 informing the Commission that they consented to the application and seeking approval for the matter to be heard without adjournment due to their inability to be represented as scheduled.

4    The application is supported by the necessary Statement of Particulars and an affidavit signed by Ms Vanessa Weber in her capacity of Adviser - Employee Relations of Employers First, representing the company. Ms Weber’s affidavit certifies that the agreement complies with all relevant statutory requirements, satisfies the no net detriment test, was not entered into under duress, and complies with the principles for approval of enterprise agreements as determined by the Commission.

5    I am satisfied that the material presented to the Commission adequately demonstrates that the Agreement submitted for approval complies with all necessary tests.

6    The J. Blackwood & Son Limited Newcastle Enterprise Bargaining (State) Agreement 2003 is approved in the terms of application, with effect from 1 January 2003 to remain in force for a period of one year therefrom.
