Application by Newcastle City Council for a new award
DECISION
[2003] NSWIRComm 329
1 This is an application by Newcastle City Council ("the Council") seeking the making of a new enterprise award to apply to Council employees represented by:
· New South Wales Local Government, Clerical, Administrative, Energy, Airlines and Utilities Union (United Services Union) (USU);
· The Development and Environmental Professionals' Association (DEPA);
· The Local Government Engineers' Association of New South Wales; (LGEA) ("the Unions").
2 The Award sought will rescind and replace the Newcastle City Council Top Value Partnership Award 2001 335 IG 691 and will operate in conjunction with the Newcastle City Council Employees' Award 2003 (Matter No IRC 5336 of 2003, Harrison DP, 10 October 2003).
3 The application was subject to hearing on 7 October 2003.
4 Ms D Platt appeared on behalf of the Council. Mr P Collins appeared on behalf of the USU with Mr N Martin. Mr G Brock appeared on behalf of the DEPA and LGEA.
5 Ms Platt submitted that the award sought is the result of extensive negotiation and discussion between the parties and complies with statutory requirements and State Wage Case principles.
6 Messrs Collins and Brock endorsed the submissions of Ms Platt and enunciated the consent of the unions to the making of the Award in the terms of the application.
7 I am satisfied that the application meets all legislative requirements; that it conforms with the relevant State Wage Case principles; and that it is presented to the Commission with the genuine consent of the parties.
8 The Newcastle City Council Top Value Partnership Award 2003 is made in accordance with the application with effect from the first pay period to commence on or after 7 October 2003 and to remain in effect until 30 November 2005.
